Manuel Agustín Heredia, nº 1, Muelle, 3, Estación marítima del Puerto de Málaga, 29001 Málaga (Spain), is formed by the website www.sterlink.es.

Intellectual and industrial property

The web portal design and its source codes, as well as the logos, trademarks and other distinctive signs which appear on it, belong to STERLINK SHIPPING and are protected by the corresponding intellectual and industrial property rights.

Content liability

STERLINK SHIPPING is not liable for the legality of other third-party websites from which the portal can be accessed. STERLINK SHIPPING is also not liable for the legality of other third-party websites which may be linked or connected from this web portal.

STERLINK SHIPPING reserves the right to make changes to the website without notice, with the aim of maintaining its information updated, by adding, modifying, correcting or removing the published content or the portal design.

STERLINK SHIPPING shall not be liable for how third parties use the information published on the portal nor for the damage suffered or financial losses which directly or indirectly generate or may generate damages, property damage or data losses as a result of using such information.

Content reproduction

The partial or full reproduction of the content published on the portal is forbidden. Nevertheless, the content considered being open and published data, in accordance with Royal Decree 1495/2011 of 24 October, implementing Act 37/2007 on the reuse of public sector information for the scope of the state public sector, can be reproduced under the terms set out therein.

5. Website user obligations and responsibilities

Users undertake to:

a) Use the website, its content and services appropriately and lawfully in accordance with:

1)    the legislation applicable at any given time;

2)    the website's general terms and conditions of use;

3)    the generally accepted morality and proper conduct; and

4)    public order.

b) Have all the technical means and requirements to access the website.

c) Provide truthful information when completing the personal data in the forms included on the website and maintain them updated at all times so that the data always conform to the users' actual situation. Users shall be the only parties responsible for providing false or inaccurate statements and for the damage caused to the company or third parties as a result of the information provided.

Notwithstanding the preceding section, users must also abstain from:

a)    Using the website and/or content without authorisation or fraudulently for unlawful purposes or effects, forbidden in these general terms and conditions of use, which harm third-party rights and interests or which, in any way whatsoever, may damage, disable, overload, deteriorate or prevent the normal use of the services or documents, files and all types of content stored on any computer equipment.

b)    Accessing or trying to access the website's restricted resources or areas without complying with the terms and conditions required for that access.

c)    Causing damage to the physical or logical systems of the website, its suppliers or third parties.

d)    Introducing or spreading computer viruses through the net or any other physical or logical systems capable of causing damage to the physical or logical systems of the company, suppliers or third parties.

e)    Trying to access, use and/or manipulate data of the company, third-party suppliers and other users.

f)     Reproducing or copying, distributing, allowing public access through any type of public communication, transforming or modifying the content, unless they have authorisation from the owners of the corresponding rights or this is legally allowed.

g)    Removing, concealing or manipulating the notices of intellectual or industrial property rights and other identification details of the rights of the company or of the third parties included in the content, as well as the technical protection devices or any information mechanisms which can be included in the content.

h)    Obtaining and trying to obtain the content by using means or procedures other than those which, where applicable, have been made available for this purpose or which have been expressly indicated on the websites that include the content or, in general, those usually used on the Internet because they do not entail any risk or disable the website and/or content.

i)      In particular and included but not limited to, users undertake not to transfer, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, stills, recordings, software and, in general, any type of material which: contravenes, denigrates or threatens fundamental human rights and public liberties recognised constitutionally, in international treaties and other legislation; induces, incites or fosters actions that are criminal, degrading, defamatory, degrading, violent or, in general, contrary to the law, morality and generally accepted good behaviour or to public order; induces, incites or fosters actions, attitudes or thoughts that are discriminatory for reasons of gender, race, religion, belief, age or social situation; includes, makes available or allows access to products, elements, messages and/or services which are criminal, violent, offensive, harmful, degrading or, in general, contrary to the law, morality and generally accepted good behaviour or to public order; induces or may induce an unacceptable state of anxiety or fear; induces or incites engaging in dangerous, hazardous or harmful practices to health and mental balance; is protected by the legislation on intellectual or industrial property rights belonging to the company or to third parties without obtaining authorisation for the use to be made; contravenes to the right to protect one's honour, the personal and family privacy, or own image; constitutes any type of advertising; and includes any type of virus or program which prevents the website's normal functioning.

If a password is provided to access some of the website services and/or content, users are obligated to use it in a diligent way, keeping it a secret at all times. Consequently, users are responsible for its appropriate custody and confidentiality, undertaking not to temporarily or permanently assign it to third parties or enable third parties to access those services and/or content. Users are also obligated to notify the company immediately of any event that may lead to the improper use of the password, such as theft, misplacement or unauthorised access, with the aim of immediately cancelling it. Consequently, if the preceding notification is not made, STERLINK SHIPPING, S.L. shall be exempt from any liability arising from the improper use of the password, and users shall be liable for any unlawful use of the website content and/or services by any unlawful third parties. If users fail to comply with any of the obligations established in these general terms and conditions in a negligent or intentional way, they shall be liable for all the damages arising for the company as a result of that non-compliance.

General Data Protection Regulation

To use some of the services, users must previously provide certain personal data, in accordance with Spanish Organic Act 3/2018 of 5 December on Personal Data Protection and Digital Rights Guarantee and REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons and implementing regulations, with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation). STERLINK SHIPPING, S. L. informs that the personal data collected shall be included and processed in an automated way in our files with the purpose of establishing commercial relations. The partial or full reproduction, including the downloading of the content of the Register to any format, shall require express authorisation from STERLINK SHIPPING, S. L.

The personal data included in the Register cannot be processed or used for purposes other than this publication.

Dispute resolutions. Applicable law and jurisdiction

These general terms and conditions of use and the website's use shall be governed by Spanish legislation. Regarding conflict resolutions, the parties waive any other venue corresponding to them and submit to the jurisdiction of the courts and tribunals of Malaga.

If any clauses of these general terms and conditions of use are unenforceable or null by virtue of the applicable legislation or as a result of a court or administrative decision, that unenforceability or nullity does not mean that these general terms and conditions of use are unenforceable or null as a whole. In such cases, STERLINK SHIPPING, S. L. shall amend or replace that clause with another one that is valid and enforceable and which, as far as possible, meets the objective and aim stated in the original clause.
